Terms and Conditions
The following Terms and Conditions constitute a binding contract between you and Airgun Warehouse, Inc. They apply to all transactions and occurrences between you and Airgun Warehouse, Inc. They are subject to change without notice. If they are changed, the Terms and Conditions at the time of each sale shall govern that sale and any other transactions or occurrences related to or arising out of that sale.
The terms “You,” “the Customer,” “the Purchaser,” and similar words like “Your” refer to you, the customer. The terms “We,” “Us,” “the Seller,” and similar words like “Our” refer to Airgun Warehouse, Inc. and its agents, employees, officers, directors, shareholders, and affiliates. The terms “Merchandise,” “Item,” and similar words like “Product” refer to any item offered or sold by us at any time, including but not limited to the item(s) in your current order.

Payment
The most efficient payment method is a credit or debit card. We accept MasterCard, Visa, American Express and Discover Card. W e also accept Paypal. ________________________________________________________________________
Shipping
We will do our best to process your order and ship it without delay. However, orders are occasionally delayed due to factors beyond our control. For instance, some of our products are shipped directly from the manufacturer or supplier, and they occasionally delay shipments for various reasons. However, we will do our best to make you, the customer, pleased with your experience with us.
Most orders ship no later than the next business day. If possible we will e-mail a tracking number to you as soon as it becomes available.
Express orders are generally shipped via Federal Express, and normally ship the next day. Orders shipped by ground usually ship within two to three business days. All orders containing CO2, Greengas, or similar products must be shipped by Standard Ground Shipping since those products cannot be shipped by air.
Backorders and Delays: We try to have most of our merchandise available to be shipped immediately, but some of our items may have to be “backordered.” This means that we do not have them in stock and cannot arrange for them to be shipped right away from the manufacturer or supplier. You can still order backordered items from our website, but they will not be shipped until they become available.
Occasionally we may show an item as “in stock” but subsequently learn that it is backordered. This sometimes happens when we rely on the manufacturer or supplier to ship an item directly to you. The item may be sold or become unavailable after an order is placed through our website. If we take an order and later learn that one of the items is backordered, we will notify you and give you the option of keeping the order in place, substituting another item, or cancelling the order. All the customer needs to do is reply to the e-mail and indicate how he or she wishes to proceed. We will always notify you of any delay within thirty days. If you choose to cancel the order, we will provide you with a prompt refund.
Our normal policy is to wait and ship your entire order, once all the merchandise is ready to ship. This keeps shipping charges down. You can request that we ship items separately, although this may increase your shipping costs.
Cancellations: Once in a while, we will accept an order then learn that we will not be able to fulfill it. For instance, the manufacturer or supplier may have something listed as “In Stock” then once an order is placed, notify us that the merchandise is no longer unavailable. If we learn that we will be unable to fulfill an order for any reason, we will cancel the order and notify you, then promptly refund your money. If we learn that an order will not ship for more than 30 days from the order date, we will cancel the order in this manner unless you instruct us to leave the order pending.
We do not make any express or implied promise that we can ship within a certain time.
If you refuse to accept delivery of your order, we will issue a credit for the product minus our shipping costs and a restocking fee of twenty percent (20%). ________________________________________________________________________
Returns
Unconditional Return: Our return policy is simple. Within 30 days of receiving your order, you may return any merchandise in new condition, with its original packaging and any accessories intact. Once we receive the returned merchandise, we will issue a refund after deducting shipping and handling charges and a restocking fee of 20%. We cannot accept return of any items that are opened, used, not in their original packaging, or otherwise not in new, saleable condition.
Defective/Damaged Merchandise: If an item is defective or damaged, you need to contact us immediately. We will issue a Return Merchandise Authorization (RMA) number. Upon receipt of the defective or damaged item(s), we will do everything we can to replace, repair, or provide substitute items.
Return Authorization: If you need to return an item (regardless of the reason), please contact us within thirty days of receiving the merchandise, to request an RMA number. Please explain the reason for the return, and we will let you know how to proceed. No returns are accepted without an RMA number. We do not accept any returns unless you have contacted us and obtained an RMA number within thirty days of receiving the merchandise. ________________________________________________________________________
Warranties
We offer a 30-day warranty on all items. We reserve the right to choose to replace, repair, or provide substitute items. All items also come with a manufacturer’s warranty, but the manufacturer’s warranty on Airsoft guns is limited to 30 days unless otherwise noted on our website. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, AIRGUN WAREHOUSE, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The Customer agrees that Airgun Warehouse, Inc. is not extending any warranties, express or implied, other than those expressly created by these Terms and Conditions. The Customer waives all other warranties.

Privacy Policy
We never share any of the personal information you provide to us (name, address, telephone, e-mail address, etc.). We do not sell your information to advertisers. The only time we provide any information about you to anyone else is when it is necessary to complete your order. For instance, our bank has to have your credit card information in order to process your payment. When your merchandise is shipped directly from a wholesaler or manufacturer, we provide them with your name and shipping address.
We take special care to keep credit card information secure. All credit card information is encrypted and secured on our computer. We keep your credit card information for 90 days after your order, in case we have to issue a refund (the credit card processor will not issue refunds after 90 days). We delete the information on the first day of the month after the 90-day period.
All orders are transmitted using Yahoo’s e-commerce. Yahoo currently uses 128-bit encryption. Yahoo’s security policies may be found on Yahoo’s website:

Safety
The fundamental NRA rules for safe gun handling are:
1. ALWAYS keep the gun pointed in a safe direction.
2. ALWAYS keep your finger off the trigger until ready to shoot.
3. ALWAYS keep the gun unloaded until ready to use.
When using or storing a gun, always follow these NRA rules:
Know your target and what is beyond. Be absolutely sure you have identified your target beyond any doubt. Equally important, be aware of the area beyond your target. This means observing your prospective area of fire before you shoot. Never fire in a direction in which there are people or any other potential for mishap. Think first. Shoot second.
Know how to use the gun safely. Before handling a gun, learn how it operates. Know its basic parts, how to safely open and close the action and remove any ammunition from the gun or magazine. Remember, a gun's mechanical safety device is never foolproof. Nothing can ever replace safe gun handling.
Be sure the gun is safe to operate. Just like other tools, guns need regular maintenance to remain operable. Regular cleaning and proper storage are a part of the gun's general upkeep. If there is any question concerning a gun's ability to function, a knowledgeable gunsmith should look at it.
Use only the correct ammunition for your gun. Only BBs, pellets, cartridges or shells designed for a particular gun can be fired safely in that gun. Most guns have the ammunition type stamped on the barrel. Ammunition can be identified by information printed on the box and sometimes stamped on the cartridge. Do not shoot the gun unless you know you have the proper ammunition.
Wear eye and ear protection as appropriate. Guns are loud and the noise can cause hearing damage. They can also emit debris and hot gas that could cause eye injury. For these reasons, shooting glasses and hearing protectors should be worn by shooters and spectators.
Never use alcohol or over-the-counter, prescription or other drugs before or while shooting. Alcohol, as well as any other substance likely to impair normal mental or physical bodily functions, must not be used before or while handling or shooting guns.
Store guns so they are not accessible to unauthorized persons. Many factors must be considered when deciding where and how to store guns. A person's particular situation will be a major part of the consideration. Dozens of gun storage devices, as well as locking devices that attach directly to the gun, are available. However, mechanical locking devices, like the mechanical safeties built into guns, can fail and should not be used as a substitute for safe gun handling and the observance of all gun safety rules.
Be aware that certain types of guns and many shooting activities require additional safety precautions.
Cleaning
Regular cleaning is important in order for your gun to operate correctly and safely. Taking proper care of it will also maintain its value and extend its life. Your gun should be cleaned every time that it is used.
A gun brought out of prolonged storage should also be cleaned before shooting. Accumulated moisture and dirt, or solidified grease and oil, can prevent the gun from operating properly.
Before cleaning your gun, make absolutely sure that it is unloaded. The gun's action should be open during the cleaning process. Also, be sure that no ammunition is present in the cleaning area.

Risks
There are inherent risks associated with the ownership, storage, use, handling, and discharging of any item that launches a projectile through the air, including airguns, BB guns, Airsoft guns, firearms, crossbows, slingshots, and any similar items. Guns that shoot blanks can also cause injury under certain circumstances. There may be other risks specific to the items which we sell. These risks vary considerably depending on the specific activity and the experience level of the participants, but they are beyond the control of the seller. These risks may include but are not limited to the possibility of property damage, injury, and/or death. There is also a risk of eye injury, and with some items, hearing damage. These consequences may be caused by gunshots, malfunctions of ammunition or equipment, ricochets, the movement of the gun itself or its parts, the storage and release of gases under pressure, other risks associated with athletic and outdoor activities, the possibility of someone mistaking an airgun or Airsoft gun for a firearm, or other causes. The consequences may be caused by the actions of the Customer, other persons, the location where the activities take place, or other factors.
You understand that Airgun Warehouse, Inc. sells certain merchandise, but Airgun Warehouse, Inc. is not responsible for providing insurance and will not be liable for any risks associated with the merchandise. You acknowledge that the cost of the merchandise would be much higher if Airgun Warehouse, Inc. was to provide that additional coverage. You agree to obtain your own insurance if desired.
The term “Claims” as used herein shall refer to any and all actual and/or potential claims, fault, liability, causes of action, lawsuits, administrative claims, or rights to damages or compensation of any kind arising out of or related to the purchase, acquisition, ownership, possession, use, or misuse of any items purchased from Airgun Warehouse, Inc., or arising out of any other dealings between you and Airgun Warehouse, Inc. The term shall include but not limited to all forms of compensation, reimbursement, offset, damages, court costs, expenses, attorney’s fees, fines, compensatory damages, economic and noneconomic damages, pain and suffering, lost earnings, punitive damages, exemplary damages, consequential damages, reimbursement, equitable claims, injunctive relief, or other legal or rights of any other kind whatsoever.
The Customer expressly agrees to limit any damages to which he or she is entitled to the purchase price of the specific merchandise out of which the specific claim arises. By way of example, if an item breaks because of a defect in workmanship or materials, or if the Customer is injured due to such a defect, then the Customer’s damages shall be limited to a refund of the purchase price of that airgun (even if it was part of a larger order).
By clicking on “I Agree” during the checkout process, you hereby release Airgun Warehouse, Inc. and its agents, employees, officers, directors, shareholders, and affiliates from any and all Claims, as that term is defined above. You also agree to indemnify, hold harmless, and defend Airgun Warehouse, Inc. from any such Claims. This includes not only any Claims which you, the Customer may have, but also any Claims that other persons may have. You waive any and all Claims, on your own behalf and on behalf of your personal representatives, heirs, successors, assigns, and relatives. ________________________________________________________________________
Legal Issues
Cities and states have different laws governing airguns and other merchandise which we sell. It is your responsibility to determine whether it is legal for you to purchase and possess our merchandise in your area. Because of these restrictions, we currently do not ship airguns, BB guns, or airsoft guns to Washington, D.C., New York City, Manhattan, Brooklyn, Bronx, Queens, Staten Island, Philadelphia, or New Jersey. We do not ship CO2 guns to Chicago. We do not ship CO2 to Puerto Rico, Hawaii or Alaska. We can ship .177 caliber air rifles and smoothbore air pistols to Michigan, but we cannot ship other airguns there.
We cannot sell airguns or certain other items to minors (anyone under 18 years of age). We require proof from each customer that he or she is an adult, and we require an adult’s signature at the time of delivery on all restricted items. By clicking on “I agree” during the checkout process, you represent and warrant that you are 18 years of age or older and that all other information you provide to us is accurate and complete.
We reserve the right to refuse service to anyone, at any time, for any reason whatsoever.
Because of the nature of the products we sell, and in order to ensure the legitimacy and legality of each order, we reserve the right to investigate and confirm the validity of any order, or of any information you provide to us. We may do this by electronic mail, checking credit card or other identifying information, by phone, or by any other means. You represent and warrant that under federal, state, and local law, you may lawfully possess firearms, airguns, Airsoft guns, ammunition, and components, and any other merchandise which you have ordered, are ordering, or may order in the future from Airgun Warehouse, Inc. Your representations, indemnifications, and waivers in this agreement shall be construed as broadly and inclusively as permitted by law. If any term or provision of this agreement is held to be unenforceable or invalid, the enforceability of the remaining terms and provisions shall remain in full force and effect. This agreement shall be governed under the law of the State of Texas. Venue for any lawsuit relating in any way to this Agreement or any other dispute involving you and Airgun Warehouse, Inc. shall be in Smith County, Texas.
You hereby acknowledge and agree that you have read these Terms and Conditions and understand each and every portion of them, including their legal effect.
